关于美国的反仇恨犯罪和《反新冠仇恨犯罪法》诞生
仇恨犯罪也被称为“基于偏见的犯罪”，指的是针对于人身安全或者财产等方面犯下的罪行，仇恨犯罪的形式有多种，一般都是基于恶意或者憎恨，其中包括恐吓、人身攻击、辱骂、财产破坏等，据统计，黑人、犹太人和同性恋是仇恨犯罪最常见的目标。
美国这个国家是一个非常善于纠错的国家，特别是在911事件发生以后。他们无论是从国家层面，还是企事业单位都会设立一套完善的预防及纠正体系（CAPAS–corrective and protective action System）。我之前工作的单位的客户基本上都是国内百强或世界五百强的单位。客户在项目外包之前，会针对比较有竞争力的Vender做一个过滤，对于稍微大一点项目外包，客户都会通过供应商信息请求（Request for information）或者是项目问卷调查表（Supplier survey）来收集供应商的详情信息，这其中就包括CAPA的问卷调查。针对仇恨犯罪，美国从国家层面就设立了非常完善的应对机制。
去年，由于受新冠肺炎的影响，针对亚裔的仇恨犯罪案件呈陡然上升趋势，峰值达到前一年的19倍，但是很快就会有媒体、社团、公众人物出来发声，比如：刘玉玲就在针对亚裔种族仇恨犯罪的言论当中，特意找到CNN的记者并与她连线，除了表明自己的立场，还呼吁社会给予关心和重视：
The rampant rise in all hate speech and Anti-Asian hate crime is plaguing our country. Words MATTER. Leadership MATTERS. Wherever you are from or whatever you look like or believe, we are all one HUMAN RACE. My heart goes out to the families of these innocent victims. I know we can be better than this. We must be.

今年年初，《反新冠仇恨犯罪法》相继被美国参议院及众议院表决通过，5月21日，该法案获签署成法。通过这个事件，我们可以管中窥豹：美国作为一个Melting pot（各种民族的大熔炉）对于仇恨犯罪的重视程度。
我们再切换到《绝望的主妇》关于Gaby的证词和供述的这段场景，Carlos的定罪的焦点集中在他是一个assailant，还是gay-basher，如果被定义为：Gay-basher那就触及了仇恨犯罪，他面临的是重罪Felony（Commission of a hate crime offense is a class C felony.），可能得呆好几年，不是在号子里面蹲几个月就能假释出狱的。
Gaby的这段证词合情合理地解释了Carlos伤人的动机，将Carlos伤人的一部分责任推到了自己身上，成功地将Carlos暴力攻击的缘由转移到了夫妻关系冲突上面，法官及陪审团也就没理由”cut Carlos some slack”了。
